Terms and Conditions
1. Scope of Services
Magic Decorating provides professional painting and decorating services to residential and commercial clients. Our services include surface preparation, painting, wallpapering, and other related tasks as agreed upon with the client.
2. Pricing & Payment Terms
2.1 Pricing Excludes Paint
All quoted prices do not include the cost of paint. Clients are responsible for selecting and supplying paint for the project unless otherwise agreed upon in writing. However, Magic Decorating is happy to supply paint upon request, provided this is agreed in advance. The cost of the paint will be added to the final invoice.
2.2 VAT
All quoted prices are subject to VAT at the current applicable rate.
2.3 Consumables Included
Our pricing includes the cost of consumables necessary for the project, such as filler, caulk, tape, sanding pads, and floor protection materials. These items are essential for achieving a high-quality finish and ensuring the longevity of the work.
2.4 Payment Terms
Invoices are issued upon completion of the project and are due immediately upon receipt. Late payments may incur additional charges as stipulated in the invoice terms.
3. Preparation Requirements & Paint Selection
Before work can commence, all rooms must be prepared as follows:
-
- Furniture: Must be moved to the center of the room or completely removed.
-
- Curtains, Blinds & Shelving: All curtains, blinds, and shelves must be taken down and removed.
-
- Surface Clearance: Walls should be clear of any decorations, photos, or other items.
-
- Paint Selection: The customer must confirm the paint colors and desired finish (e.g., gloss, satin, eggshell, or matte) for each area to be painted before work begins.
Failure to meet these preparation requirements may result in delays, additional charges, or rescheduling of the project. If rooms are not properly cleared as outlined, a charge of £25 + VAT per hour will be applied for time spent clearing the area.
4. Liability
4.1 General Liability
Magic Decorating will exercise reasonable care while carrying out its work. However, we are not liable for any damages caused during the execution of the project, including but not limited to:
-
- Scratches, scuffs, or other damages to furniture, flooring, or walls while transporting equipment and materials into and out of the property.
-
- Any damage resulting from the removal or reinstallation of windows, doors, or other fixtures.
4.2 Third-Party Liability
Magic Decorating is not liable for any damages caused by third-party contractors or individuals hired independently by the client.
5. Insurance
Magic Decorating holds comprehensive public liability insurance. However, clients are encouraged to notify their home or business insurance providers of any ongoing renovations or decorating work to ensure coverage.
6. Cancellation & Rescheduling
6.1 Cancellation
Cancellations must be made at least 48 hours before the scheduled start date of the project.
6.2 Rescheduling
Clients may request to reschedule their project start date with at least 48 hours’ notice. Requests made within 48 hours of the start date may be subject to availability and potential additional charges.
7. Changes & Additional Work
7.1 Scope Changes
Any changes to the agreed scope of work (e.g., additional rooms, different paint finishes, or added services) must be confirmed in writing. Such changes may result in a revised quote and additional costs.
7.2 Unforeseen Issues
If unforeseen issues arise during the project, such as blown plaster, rotten wood, or flaking/peeling paint, we will inform the client immediately. Additional charges may apply to address these issues before continuing with the agreed work.
8. Work Hours & Access
8.1 Standard Working Hours
Our standard working hours are 8:30 AM – 4:30 PM, Monday to Friday. If work is required outside these hours, it must be agreed upon in advance and may be subject to additional charges.
8.2 Access to Property & Facilities
The client must provide adequate access to the property, including access to power and water as needed. Additionally, access to on-site toilet facilities is required for the duration of the project.
9. Health & Safety
Magic Decorating aims to keep the working areas as clean and safe as possible. However, clients and other individuals on-site are responsible for being cautious around tools and materials that may be present during the project. Magic Decorating will not be held accountable for any injuries sustained as a result of failure to observe these precautions.
10. Final Inspection & Sign-Off
Upon completion of the project, a final inspection will be conducted with the client to ensure satisfaction with the work. Any touch-ups or corrections will be addressed at this time. Once the client signs off on the project, Magic Decorating is no longer responsible for any changes or adjustments.
11. Property Protection
While we take precautions to protect property during the project, we recommend that clients remove any high-value or fragile items from the area. Magic Decorating is not responsible for loss or damage to these items.
12. Use of Photos & Testimonials
Magic Decorating may take photos of completed work for marketing purposes and to showcase our portfolio. We will always seek permission from the client before using any images that include personal or identifiable items.
Client testimonials may also be used for marketing purposes, including website and social media content, with prior written consent from the client.
13. Third-Party Materials & Warranty
Magic Decorating cannot be held liable for defects in third-party materials or products (e.g., wallpaper, specialty finishes) supplied by the client or manufacturers. Any warranties or guarantees for these materials should be pursued directly with the supplier.
If the client provides the paint for the project and it fails or performs poorly (e.g., peels, discolors, or cracks), Magic Decorating is not liable for any resulting damage or rework required. We recommend using high-quality materials to ensure the best results.
14. Unforeseen Property Conditions
If work cannot be completed as planned due to unexpected structural or property conditions (e.g., severe damp, infestation, unstable surfaces), Magic Decorating reserves the right to suspend work until the issue is resolved. Additional costs may be incurred for any subsequent repairs or adjustments needed before the project can continue.
15. Additional Charges for Hazardous Materials
If hazardous materials such as asbestos are discovered on-site during the project, all work will cease immediately until a certified professional can safely remove and dispose of the materials. Magic Decorating will not be held liable for delays or additional costs associated with the removal or treatment of hazardous materials. All costs related to the removal, treatment, and resumption of the project will be borne by the client.
16. Force Majeure
Magic Decorating shall not be liable for any failure to perform, or delay in performing, any of our obligations under these terms caused by events outside our reasonable control (e.g., adverse weather conditions, illness, or equipment failure).
17. Acceptance of Terms
By engaging our services, the client acknowledges that they have read, understood, and agreed to these terms and conditions. These terms apply to all projects unless otherwise amended in writing by Magic Decorating.
